Terms of Service
These terms are an agreement between you and Friends of Play and Prosper LLC, a New Hampshire limited liability company ("we", "us"), which operates counthis.app (the "Service"). By using the Service, including by embedding a counthis badge, you agree to these terms and to the Acceptable Use Policy. If you do not agree, do not use the Service.
The Service
The Service counts views of web pages, profiles and repositories and shows the count as an image ("badge") or as data from the API. A counter is identified by what it counts, such as a GitHub username or a website address.
Counts are estimates. We count each visitor at most once per counter every six hours, we do not count requests we believe come from bots or servers, and views that reach us through image proxies (such as GitHub's) cannot be told apart and are limited per counter. We may change how views are counted to keep counts fair.
Eligibility
You must be at least 16 years old to create an account or buy a subscription. If you use the Service for an organization, you confirm you may bind it to these terms.
Accounts
Accounts have no passwords. You sign in through a link we email you, which works only from the network where you asked for it. Keep control of your email address: anyone who can read your email can sign in to your account. Each email address may hold one account; addresses that differ only by a "+tag" are treated as the same address.
Free counters
Anyone may create counters without an account. A free counter keeps counting, but its badge shows at most 369 and reads "369+" beyond that. An account without a subscription keeps 369 counters active.
Subscriptions
A subscription unlocks the full number on your counters. It is sold in blocks: each block covers 500 counters for one term of 369 days and costs $7.77. Subscriptions are prepaid.
Each payment for a new term adds 369 days to your current term, or starts a new term if your counters are inactive. Blocks added during a term are charged for the days left in it.
- Card payments are processed by Stripe. Card subscriptions are billed every year and renew automatically unless you cancel in the billing portal before the renewal date; because each payment adds 369 days, a renewing card subscription gains a few days every year. Changing the number of blocks is prorated by Stripe. Applicable taxes may be added at checkout.
- RLUSD payments are made on the XRP Ledger to the address shown at checkout, with the destination tag shown. A payment counts once it is validated on the ledger and the amount delivered (not the amount sent) is at least the price; a shortfall can be topped up with another payment to the same tag. The price in RLUSD is fixed when you create the order. Ledger payments do not renew automatically; we will remind you when a term ends. Ledger transactions are public and cannot be reversed. Sending the wrong asset, amount, address or tag may result in loss of funds; we will try to help but cannot guarantee recovery. We accept RLUSD only, never other stablecoins.
- Agent payments (x402): software acting for your account may pay through the API by sending a signed RLUSD payment with its request. We submit it to the XRP Ledger and credit your account once it is validated. You are responsible for payments made with your API tokens.
Except where the law requires otherwise, payments are not refundable. We may change prices for future terms with at least 30 days' notice.
When a subscription lapses
If a term ends without renewal, your counters keep working normally for 90 days. During the last 25 of those days your badges turn gradually red. When the grace period ends, counters beyond the free allowance stop counting and show "inactive", and free-tier limits apply to the rest. We send up to three reminders, by email and, if you paid from an XRP Ledger address, as a payment of a tiny amount of XRP to that address with a short note. Data of inactive counters is deleted 17 months after the last reminder, unless you renew first; we may set an earlier or later date for your account and will show it in your account.
An account may receive a grace period for at most 490 lapses. The next lapse permanently suspends the account.
Ownership of names
You may claim a counter only for something you control, such as your own GitHub account, organization or repository, your dev.to profile or your domain. We may ask you to prove control, for example by publishing a code we give you in a file in your repository, in your first dev.to post, or in your domain's DNS. If the proof is later removed, your claim ends, and the counter may be claimed by someone else, in which case its count starts again from zero. We may resolve disputes over names at our discretion.
Combined badges that add up several names show a number only when the same account has verified every name.
API
You may read counts and manage your counters through the API with a token issued to your account. Keep tokens secret; anything done with your token is treated as done by you. We may limit request rates.
Your content
Labels, colors and names you choose for badges remain yours. You give us permission to store and display them as needed to run the Service.
Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free, and counts may be lost if a failure occurs between saves. We may change, suspend or end any part of the Service. If we end the Service entirely, we will give reasonable notice and refund the unused part of prepaid terms.
Suspension and termination
We may suspend or close accounts and disable counters that break these terms or the Acceptable Use Policy, or that put the Service or others at risk. You may close your account at any time.
Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and US $20.
Indemnity
You will defend and indemnify us against claims arising from your misuse of the Service or your breach of these terms.
Governing law
These terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located in New Hampshire, and you consent to their jurisdiction. Nothing here limits rights you have under the consumer protection laws of the country where you live.
Changes to these terms
We may update these terms. We will post the new version here with a new effective date and, for material changes, notify account holders by email at least 30 days in advance. Continuing to use the Service after the change takes effect means you accept it.
